Wild Renata Flowers Contract
Contract Terms and Conditions.
References in this contract to “you”, “your” “yours” refer to the Client or any persons authorised by the Client to act on their behalf and as communicated to Wild Renata Flowers in writing.
References to “us”, “we”, “our” refer to Wild Renata Flowers.
“Event Date” means the date of your event as communicated by you in writing and confirmed in the Final Quotation.
1. All consultations will be made by appointment only. You can contact us by phone or email to arrange an appointment. Your initial consultation will be free of charge (“Initial Consultation”). We will be available for contact by phone and email at any stage to answer any questions and queries you may have.
2. After your Initial Consultation a free of charge quotation for the cost of your event flowers will be sent out to you (“Initial Quotation”). This is a guide price and may be subject to change following the detailed consultation to account for any changes you make, any such changes will be captured in the follow up quotation (“Final Quotation”).
3. If you wish to proceed following the Initial Quotation you will be required to sign and return this contract. Signature of this contract does not obligate you to place an Order. Following receipt of a signed contract a follow up detailed consultation will be arranged.
4. After the submission of the Initial Quotation any further quotations are only free of charge if you place an Order with Wild Renata Flowers for your event. Save for the Initial Quotation, Wild Renata Flowers reserve the right to invoice you for time spent on developing any further quotation at an hourly rate of £25/hr if you do not place an Order.
5. A non-refundable booking deposit of 50% of the Final Quotation is required to hold and book your Event Date which will be invoiced to you. You are required to pay the deposit within 7 days of the date of the Final Quotation. Upon receipt of this deposit your order for your Event Date is confirmed (“Order”). This deposit will be subtracted from your final invoice. If for any reason you decide to cancel your event, this deposit is non-refundable. If you decide to postpone your event, we will hold the deposit until the event goes ahead and you may be subject to rearrangement fees and renegotiation of the Final Quotation. Please refer to cancellation fees below.
6. Any changes made to an Order must be submitted by you in writing to Wild Renata Flowers. Wild Renata Flowers will endeavour to accommodate any alterations to the Order but any reduction in any quantities of required products or services will not be accepted and the full agreed balance will be payable in accordance with the terms of this contract. Any changes to an Order may result in additional charges and these will be added to the final invoice and be payable by you.
7. As fresh flowers and foliage are living products, there are occasions when particular varieties, shades and head sizes may be unavailable. Flowers are also susceptible to seasonal changes and weather conditions which may give rise to unforeseen and uncontrollable availability issues prior to the Event Date. Whilst every effort is made to source products accordingly, sometimes we are unable to obtain particular types of flower. All fresh flowers and foliage are subject to availability and stringent quality checks. As such Wild Renata Flowers reserve the right to make floral substitutions and use similar flowers in place of the previously chosen flower. This includes substitutions within a specific colour palette. Such necessary substitutions will be at Wild Renata Flowers discretion although, where possible within the timescales, we will seek to agree such substitutions with you before the Event Date.
8. Wild Renata Flowers works hard and makes every effort to match each flower to each visual brief however as we work with a natural product some produce may look slightly different to images found on the internet or other visual sources.
9. The final invoice (which will consist of the remainder of the Final Quotation plus any additional charges agreed as a result of changes to an Order) must be paid in full no later than 30 days before the Event Date.
10. If payment of the balance due is not made in accordance with clause 9 above, flowers and decor will not be ordered and Wild Renata Flowers Reserves the right to terminate this contract and the applicable cancellation charges will apply (see clause 11 below). If Wild Renata Flowers determines the contract can still be fulfilled and you wishe to continue with the Order, there will be a fee of 10% of the final invoice added to the balance due and an additional 10% fee for each 7 days that the balance is late. Any extraordinary costs incurred reasonably incurred due to the late payment will be payable by you.
11. Cancellation Charges:
a. All deposits are non-refundable.
b. Cancellations made between 60-30 days prior to the Event Date will incur an administration charge of £250.00 in addition to the deposit.
c. If an Order is cancelled within 30 days or less of the Event Date then the full balance will be payable.
12. Where applicable, all damage deposits will be refunded with 28 days of receipt of items returned to Wild Renata Flowers in the same condition you received them. Breakages of hired items will be invoiced to you at the cost in GBP to replace such items.
13. If you have any complaints or issues regarding Wild Renata Flowers final florals designs or instalment of flowers for your event you must raise these within 48 hours of your Event Date to enable us to investigate accordingly. A photograph will be required to support any claims. Wild Renata Flowers is not obligated to provide a refund and any such refund will be entirely at our discretion. Please note that fresh flowers cannot be returned.
